Decree of Distribution
The Distributees of Cornelius Latham Jr., Dec'd;
The Administrators of Cornelius Latham Jr., Dec'd.
Cornelius Latham, Jr. & Enoch Lathem, Administrators of the estate of Cornelius Latham Jr., Dec'd, having this day, bringing in their accounts as well for Receipts of said estate as disbursements and the same being here examined corrected and allowed and having ascertained that the said Administration, after deducting all disbursements, have in their hands [of which] belonging to said estate, for distribution to the respective persons entitled thereto as descendants, as heirs of said Cornelius Latham, two thousand seven hundred and fifty six dollars & twelve cents.
And the Court being now informed and sufficiently advised by said Administrators that the said Cornelius Latham Jr., Dec'd, at his death, left a wife, Elizabeth Latham by name, and diverse children of the names following to wit, John Cagle & Sally his wife, late Sally Latham, Jacob Cagle and Polly his wife, late Polly Latham, William Garner & Susan his wife, late Susan Latham, George Cagle & Nancy his wife, late Nancy Latham, John Boling & Patsy his wife, late Patsy Latham, Bellaver Britt & Lucretia his wife, late Lucretia Latham, James Latham, Cornelius Latham Jr., Administrator, John Latham, Enoch Latham Administrator, and John Hicks & Catherine his wife, late Catharine Latham, all of whom are yet alive and also diverse grandchildren to wit, John Lawley & Polly his wife, late Polly Latham, William Garner & Nancy his wife, late Nancy Latham, John Garner & Betsy his wife, late Betsy Latham, Samuel Snider & Mary his wife, late Martha Latham, Allen Raleigh & Sally his wife, late Sally Latham, Evan Howard and Rebecca his wife, late Rebecca Latham, James Latham, Jesse Latham, Margaret Latham, Amy Latham, William Latham and Andrew Latham, in right of their deceased father William Latham a son of the said Cornelius Latham Jr. Dec'd which said children are yet alive.
And also the children of Elizabeth Tucker, dec'd, a former wife of Jesse Tucker of Tennessee who was a daughter of the said Cornelius Latham, Dec'd, in right of their said mother, their names and numbers being unknown, who are the legal distributees of said descendants estate and are entitled to distribution thereof.
And no objection being made, this Court does now proceed to decree distribution of said estate as follows:
First that the said Cornelius Latham, Jr. & Enoch Latham, Administrators as aforesaid, pay unto Elizabeth Latham, widow & relict of said Cornelius Latham, dec'd, the sum of five hundred & fifty dollars, twenty two & two fifth cents, out of said asset for distribution in their hands, it being one fifth part of said assets as her distributive share to hold to her in absolute rights as her own property.
Second it is further decreed that the said Cornelius Latham Jr. & Enoch Latham, Administrators as aforesaid pay unto the said John Cagle & Sally his wife, late Sally Latham the sum of one hundred sixty nine dollars, sixty & 3/3 cents out of the assets aforesaid.
And it is further decreed that the said Cornelius Latham Jr. & Enoch Latham, Administrators as aforesaid pay distribution unto the said Jocob Cagle & Polly his wife, late Polly Latham the sum of One hundred and sixty nine dollars, sixty & 3/3 cents of the assets aforesaid.
And it is further decreed that the said Cornelius Latham Jr. & Enoch Latham Administrators as aforesaid pay unto the said William Garner and Susan his wife, late Susan Latham the sum of One Hundred & sixty nine dollars, sixty & 3/3 cents out of said assets.
And it is further decreed that the said Cornelius Latham Jr.. & Enoch Latham Administrators as aforesaid pay & distribute unto the said George Cagle & Nancy his wife late Nancy Latham the sum of One hundred and sixty nine dollars, sixty & 3/3 cents out of the assets.
And it is further decreed that the said Cornelius Latham Jr.. & Enoch Latham, Administrators as aforesaid pay distribution unto the said John Boling & Patsy his wife late Patsy Latham the sum of One hundred and sixty nine dollars, sixty & 3/3 cents of the assets.
And it is further decreed that the said Cornelius Latham Jr.. & Enoch Latham Administrators as aforesaid pay distribution unto the said Bellaver Britt & Lucretia his wife, late Lucretia Latham the sum of One hundred and sixty nine dollars, sixty & 3/ cents out of the assets.
And it is further decreed that the said Cornelius Latham Jr. & Enoch Latham Administrators as aforesaid pay distribution unto the said James Latham the sum of One hundred and sixty nine dollars, sixty & 3/3 cents out of the assets.
And then Decreed that said Cornelius Latham, Administrator as aforesaid retain as his share of said estate the sum of One hundred and sixty nine dollars, sixty & 3/3 cents out of the assets.
And it is further decreed that the said Cornelius Latham Jr.. & Enoch Latham, Administrators, as aforesaid pay distribution unto the said John Latham the sum of One hundred and sixty nine dollars, sixty & 3/3 cents out of the assets.
And it is further Decreed that said Enoch Latham, Administrator, as aforesaid retain as his share of said estate the sum of One hundred and sixty nine dollars, sixty & 3/3 cents out of the assets.
And it is further decreed that the said Cornelius Latham Jr. & Enoch Latham Administrators as aforesaid pay distribution unto the said John Hicks & Catherine his wife late Catherine Latham the sum of One hundred and sixty nine dollars, sixty & 3/3 cents out of the assets.
And it is further decreed that the said Cornelius Latham Jr. & Enoch Latham, Administrators as aforesaid pay distribution to the children of the said William Latham, dec'd, the sum of One hundred and sixty nine dollars, sixty & 3/3 cents out of said assets to wit:
To John Lawley & Polly his wife late Polly Latham the sum of fourteen dollars thirteen 4/2 cents
To William Garner & Nancy his wife, late Nancy Latham the sum of fourteen dollars, thirteen 4/2 cents.
To John Garner & Betsy his wife, the late Betsy Latham the sum of fourteen dollars, thirteen 4/2 cents
To Samuel Snider & Martha his wife, late Martha Latham, the sum of fourteen dollars, thirteen 4/2 cents
To the said Allen Raleigh & Sally his wife, late Sally Latham, fourteen dollars, thirteen 4/2 cents
To the said Evan Howard & Rebecca his wife, late Rebecca Latham the sum of fourteen dollars, thirteen 4/2 cents
To the said James Latham, the sum of fourteen dollars, thirteen 4/2 cents
To the said Jesse Latham the sum of fourteen dollars, thirteen 4/2 cents
To the said Margaret Latham the sum of fourteen dollars, thirteen 4/2 cents.
To the said Amy Latham, the sum of fourteen dollars, thirteen 4/2 cents
To the said William Latham the sum of fourteen dollars, thirteen 4/2 cents.
And to the said Andrew Latham the sum of fourteen dollars, thirteen 4/2 cents the residue of the share and sum aforesaid descends to them in right of their deceased Father the said William Latham Dec'd.
And lastly it is further decreed that said Cornelius Latham & Enoch Latham, adm. pay & distribute to the children of the said Elizabeth Tucker, when their names and number are known, as their legal guardian, as agent, applies in equal part to be divided between them the sum of One hundred & sixty nine dollars sixty & 3/3 cents the residue of the aforesaid assets in the hands of said administrators. All which is adjusted ordered and decreed accordingly.
